These Terms of Service (“Terms”) govern your use of myestimator.app, the Estimator App estimator tools and related services (the “Service”) provided by Estimator App Inc. (“Estimator App”, “we”, “us” or “our”). By using the Service you agree to these Terms.

1. The Service

Estimator App provides online renovation cost estimator tools that contractors can place on their websites to collect project details from homeowners and deliver them as leads.

2. Accounts and subscriptions

Subscriptions are billed monthly or yearly in advance through our checkout provider. You are responsible for keeping your account information accurate. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

3. Estimates

Estimates produced by the Service are approximate ranges for planning purposes only. They are not binding quotes, offers or professional advice. Final pricing is set by the contractor after review of the actual project.

4. Customer responsibilities

Customers who place an estimator on their website are responsible for their own use of lead information, for having a privacy policy on their site, and for complying with applicable laws, including anti-spam and telemarketing laws, when contacting leads.

5. Acceptable use

You agree not to misuse the Service, including by submitting false information, interfering with the Service, attempting unauthorized access, or using it for any unlawful purpose.

6. Messaging Terms

By providing your mobile number and opting in, you agree to receive text messages from Estimator App related to your estimate request, your account, billing and customer support. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time and HELP for help, or contact [email protected]. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. 7. Intellectual property

The Service, including its software, estimator logic, design and content, is owned by Estimator App Inc. Customers receive a limited, non-exclusive, non-transferable right to use the Service during an active subscription.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. We do not guarantee any number or quality of leads or any business result.

9. Limitation of liability

To the maximum extent permitted by law, Estimator App will not be liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

10. Indemnity

You agree to indemnify Estimator App against claims arising from your misuse of the Service or your violation of these Terms or applicable law.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ottawa, Ontario.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
